What is a Public Record?

“Public records” means all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law or ordinance or in connection with the transaction of official business by any agency. (F.S. 119.011(12))

Requests and Fulfillment

Public records held by the City of Oldsmar are available upon request for inspection or copying pursuant to Chapter 119, Florida Statutes, and Article I, s. 24 of the State Constitution.

Some public records are already provided for the public on the City's website and are immediately available for viewing and downloading. For example, you may obtain copies of the City Budget at This LINK.

Other records are not as readily available and will have to be located, reviewed for information exempt from disclosure, and redacted if necessary. The time to fulfill a public records request will vary depending upon the particular records requested and the volume of the request. Our Records Management Liaison Officer, Kristin Garcia, is committed to fulfilling your request as quickly and efficiently as is reasonably possible.

Costs

For extensive requests estimated to take more than 30 minutes for staff to complete, a special service charge based on the amount of time to locate, review and copy the records should be imposed. The City Clerk will provide the requestor with an estimate of costs including staff time and copying costs to complete the request. A minimum deposit of half the estimated fee will be required. The deposit will be applied to the final cost of the public records request. Upon request, the City will furnish copies of public records based on the following fee schedule:

  1. Duplication of records that are 10 pages or less shall be provided at no cost to the requestor.
  2. Single-sided copies, up to 8 ½” x 14” - $0.15 each
  3. Double-sided copies, up to 8 ½” x 14” - $0.20 each
  4. $1 per copy for a certified copy of a public record 

Florida Statutes, 119.07(1)(d) provides that if the nature or volume of public records requested to be inspected or copied pursuant to this subsection is such as to require extensive use of information technology resources or extensive clerical or supervisory assistance by personnel of the agency involved, or both, the agency may charge, in addition to the actual cost of duplication, a special service charge, which shall be reasonable and shall be based on the cost incurred for such extensive use of information technology resources or the labor cost of the personnel providing the service that is actually incurred by the agency or attributable to the agency for the clerical and supervisory assistance required, or both.
